The Federal High Court sitting in Akure has fixed July 14 2022 to hear the case instituted by Dr Segun Ategbole over the purported kangaroo primaries organized by the All Progressive Congress at The Dome, Akure where Otunba Adefarati Gboyega was declared winner.
Four of the five aspirants who were cleared to contest in the party primary election in the Constituency, have approached the court for redress.
Ategbole is challenging the validity of the primary election which produced Mr. Gboyega Adefarati as the All Progressives Congress’ candidate in the May 2022 primary election for the seat.
Not satisfied with the outcome of the primary election, the plaintiff filed the suit alleging that the exercise was marred by grave and substantial noncompliance with the spirit and purpose of the APC’s Constitution, Electoral Guidelines and Electoral Act, 2010 (as amended).
Dr Ategbole among other aspirants not satisfied with the conduct of the primary approached the party’s Appeal Committee who ordered that there was no primary in my Constituency.
PATH was reliable informed that the ordered of the Appeal Committee for the conduct of fresh primary was disregarded under the excuse of insecurity.
Forming part of the prayer of Dr Ategbole in court is that a new primary election be conducted in the federal Constituency.
Meanwhile, after taking an oral application for the commencement of trial from the counsel to petitioner, Barrister shola Ajisafe, the Presiding Judge, Justice Demi Ajayi adjourned the case to July 14 for hearing.
